Key Findings: EU AI Act Postpones High-Risk AI Obligations by Up to Two Years, Strengthens Penalties
The European Council has granted final approval to amendments to the EU AI Act, delaying the enforcement schedule for key obligations, particularly those concerning high-risk AI systems. Consequently, standalone high-risk AI systems under Annex III will become subject to regulation from December 2, 2027, while high-risk AI systems integrated into regulated products will follow from August 2, 2028. Transparency rules will, however, come into effect in August 2026. The Act aims to build trust in AI among European citizens by imposing rigorous requirements for transparency, safety, fairness, and human oversight. Non-compliance could result in substantial fines, reaching up to €35 million or 7% of a company’s global annual turnover.
Technical & Clinical Details: Risk-Based Classification and Stringent Requirements
- Risk-Based Classification: The EU AI Act categorizes AI systems based on their risk level, imposing more stringent requirements on those deemed “high-risk.” Many HR AI use cases (e.g., recruitment, task assignment, performance evaluation), medical devices, and AI embedded in critical infrastructure fall under the “high-risk” category.
- Key Obligations:
- Transparency: Providing users with clear information about the AI system’s capabilities, limitations, and intended purpose.
- Safety: Ensuring AI systems function as intended and minimize security risks.
- Fairness: Guaranteeing AI systems are free from bias and do not generate discriminatory outcomes.
- Human Oversight: Ensuring the possibility of effective human oversight and intervention in the operation of high-risk AI systems.
- Data Governance: Assuring the quality and integrity of datasets used by AI systems.
- Detailed Enforcement Schedule:
- Prohibited AI systems: August 2, 2026 (some by August 2, 2027)
- Transparency requirements: August 2, 2026
- General-purpose AI models’ governance requirements: February 2, 2027
- Standalone high-risk AI systems (Annex III): December 2, 2027
- High-risk AI systems incorporated into regulated products: August 2, 2028
Background & Context: Enhancing AI Trust and Economic Impact
The EU AI Act aims to promote the ethical and high-quality deployment of AI technology and build an environment where European citizens can trust AI. In Germany, the Federal Network Agency will serve as the central market surveillance authority for monitoring and enforcing the AI Act. This legislation goes beyond mere compliance obligations, urging organizations, particularly HR departments, to more rigorously consider the quality of AI systems and their management.
While AI adoption significantly contributes to organizational efficiency, its inappropriate use carries legal risks and potential damage to corporate reputation. Companies must strengthen their AI governance frameworks and establish strategies to identify and mitigate potential risks.
Strategic Significance & Outlook: Compliance and Strategic AI Asset Utilization
The enforcement delay provides companies with additional time to comply with the complex requirements of the AI Act. However, it also presents an opportunity for organizations to more stringently evaluate the quality of their AI assets and the governance surrounding them. Adherence to the AI Act will be a critical factor in integrating ethical and responsible AI use into business strategies and establishing a competitive advantage. Companies must establish comprehensive compliance plans and implementation frameworks now to avoid penalties and maximize the benefits of AI technology.
